IPR2 undertook a number of activities in April 2010 – including support to the EU-China IP Dialogue, two training programmes, mediation support and updating a publication – covering IP protection at trade fairs, criminal enforcement, international developments in IP and the new Patent Law. The implementation of a number of activities was adversely affected by the volcanic ash in Europe and had to be cancelled or postponed. DIALOGUE - Support to 6th EU-China IP Dialogue 2010, Beijing, 8-9 April 2010
The 6th EU-China IP Dialogue took place in Beijing over two days, co-chaired by Ms Ewa Synowiec, Director, DG Trade in the European Commission and Ms. Li Ling, Director-General, Department of Treaty and Law of the Ministry of Commerce of P.R. China. The Dialogue continues the EU and China’s relationship on IP-related issues giving both sides the opportunity to exchange their views on developments with Europe and China’s respective IPR policy, update on progress made and consider the way forward on key action areas such as trademarks, copyrights, patents, geographical indications, innovation and standardisation, plant variety protection and indigenous-innovation products.
   
       
 


STAKEHOLDER BRIEFING – IPR2 Stakeholder briefing and networking, 22 April 2010, Vienna - cancelled

“Results and perspectives 2010: Third year of China's National IP Strategy, third year of IPR2 cooperation”: In 2010 IPR2 enters its third year of implementation in China. At the same time, China is moving into a third year of its national IP strategy. Regrettably, due to the volcanic ash in Europe, this event was cancelled. The IPR2 team looks forward to preparing another opportunity for stakeholders in Europe to convene, to highlight the Project’s results and priorities and update on IPR protection and enforcement in China in various areas (patents, copyright, trademark, etc).

   

   
MEDIATION - EU-China support to IP protection at trade fairs in Europe
Frankfurt Messe, Germany, 11-16 April 2010 and Hanover Messe, Germany, 19-24 April 2010 In 2010, IPR2 is continuing its co-operation with the Ministry of Commerce (MOFCOM) and the China Council for the Promotion of International Trade (CCPIT) to support the protection of intellectual property at trade fairs with information and mediation support at two of the world’s most significant exhibitions in Germany – Frankfurt Messe and Hanover Messe.
 
       
 

TRAINING - EU-China training on criminal IPR enforcement, Dongguan, 7-9 April and Wuhan 13-15 April 2010
IPR2 held two three-day trainings with the Supreme People’s Procuratorate (SPP) on criminal enforcement of IP rights for local procuratorates and prosecutors. The training contributed to increasing the qualifications of the 225 prosecutors who participated, in terms of handling IPR cases as well as  increasing the exchange of information between Chinese prosecutors and enforcement officials and industry right holders on best practices of criminal enforcement. The training aimed to highlight the different concepts linked to the determination and valuation of the ‘infringing mass’ in the EU and China, addressing a series of legislative and technical enforcement questions.
   
       
 











TRAINING - EU-China training on latest developments on IPR, Guangzhou, 6-7 April 2010

IPR2 co-operated with the College of Intellectual Property of Jinan University in holding training on the latest developments of IPR in the context of globalisation. The training gathered experts from Europe and China across various faculties to review recent developments in IP protection around the world, including IP litigation trends, experience of enterprises in advanced countries in IPR management and IPR protection and strategies of protection in emerging countries. It addressed IP professionals in Guangdong province, including judges, lawyers, academia, government officials, and graduate students from the IP College and the College of Economics at Jinan University; with the aim of increasing local awareness of IPR protection and promoting IPR protection work among companies in the Pearl River Delta.

“The seminars looked at how to create value from intellectual property and structural capital in the context of a globalised knowledge rich economy which is only now beginning to recover from the 2008 financial crisis. Recent developments in  “developed” and “developing” countries were reviewed and tools were discussed which allow any organisation to manage its IP and structural capital for value in relation to existing opportunities and its current business plan. The seminars received a very positive response particularly as the content emphasized proactive use of IP in creating business deals brought to life using case studies and directly addressed opportunities current in China.” Dr Gordon McConnachie, Coordinator Global Association of Intellectual Capital Practitioners, Chief Technology Officer Asia Pacific Intellectual Capital Centre (APICC), Hong Kong and Founding Chairman Intellectual Assets Centre, Scotland.

   
       
 
OHIM’s cooperation agreements with China, Beijing, 29 April 2010
The Office for Harmonisation in the Internal Market (OHIM), the EU’s office for trademarks and designs, has agreed a new cooperation framework with the Chinese authorities following a successful mission to China led by Mr Wubbo de Boer, President of OHIM. Mr de Boer met with Vice Minister Fu Shuangjian of the State Administration for Industry and Commerce (SAIC) and Commissioner Tian Lipu of China’s State Intellectual Property Office (SIPO), reaching new agreements on a series of actions to be carried out in the framework of IPR2 and under bilateral agreements.
   
       
 
EU launches free trademark search engine, Brussels, 13 April
The European Commission has launched ‘TMview’, a free online database enabling users to search more than 5 million trademarks registered with the European Union’s official Intellectual Property Offices. Whereas, previously users would have search a number of database in different languages in order to determine if a trademark was already registered in the EU, this new service aims to significantly streamline the process for potential brand owners.
   
   
         




PUBLICATION – Updated 'Third Revision of China's Patent Law: Legal texts and documents on the drafting process 2006-2008'
The 'Third Revision of China's Patent Law: Legal texts and documents on the drafting process 2006-2008' has been updated. The publication compiles the most relevant documentation at each stage of China’s Patent Law revision, including the full text of the new Patent Law, its drafts and comments from the European Union at each stage of the revision; with this new edition including the associated Implementing Regulations of the Patent Law effective as of 1 February 2010 and the Interpretations of the Supreme People’s Court on Several Issues Concerning Adjudicating Patent Infringement Disputes, effective on 1 January 2010 as well as comments on the respective drafts. This forms part of IPR2’s work on supporting revision of China’s major IP laws. The publication is provided free-of-charge and may be downloaded at www.ipr2.org/patentlaw

PUBLICATION - IPR2 Roadmap for IP Protection series on CD
The IPR2 Roadmaps provide information on the IP systems in China and Europe and to give guidance to both European and Chinese companies in protecting their IP. All issues are available to download free-of-charge from www.ipr2.org/roadmap and are also provided on a compilation CD.

EU-China study tour on Trademark Law and IP-related aspects of Civil Procedure Law, The Netherlands, France, Switzerland, 30 May-5 June 2010
IPR2 is supporting a study tour of officials from the Legislative Affairs Commission (LAC) responsible for drafting the up and coming revision of the Trademark Law and Civil Procedure Law. The delegates, from the economic and civil law offices of LAC, will meet with European justice and economic ministries, trademark offices, academic, research and IP institutes, courts, industry associations and law firms as well as representatives from the World Intellectual Property Office (WIPO) and the World Trade Organisation (WTO), as part of gathering and exchanging information relevant to their drafting work.

EU-China study tour on trademark registration and judicial review
; Spain and Germany; 5-12 June 2010
IPR2 will organise a study tour for a delegation of officials from the State Administration of Industry and Commerce (SAIC) and trade mark judges to Spain, Luxembourg and Germany, to build knowledge of on the European trademark system and support an exchange of expertise between Chinese and European officials and judges on emerging trademark registration and judicial review issues.

EU-China roving seminars on the Chinese trademark system, Spain and Germany, 9 and 11 June 2010
IPR2, together with the State Administration for Industry and Commerce (SAIC), will organise two one-day seminars in Madrid and Munich on the China’s trademark system. The seminars will also address SAIC’s management of the system, including business tools, performance and statistical information as well as quality and customer care. European industry interested in doing business with China and trademark holders already engaging in trademark protection are invited to participate.

International Seminar on IP protection of software, Dalian, 23 June 2010
IPR2 is supporting the ‘International Seminar on Intellectual Property Protection of Software’, organised by the China Association of Trade in Services (CATIS) as entrusted by the Ministry of Commerce, with the support of the Copyright Protection Centre of China (CPCC) and the Dalian Copyright Protection Association.

EU-China study tour on on-line copyright protection, France, Belgium, Germany, 10-19 May 2010
IPR2 is supporting a study tour for a delegation of the Chinese Judiciary (Supreme People’s Court or SPC as well as Chinese High Courts and Intermediary Courts) on the protection of copyrights on the internet. The study tour aims to share experience on Europe’s latest developments of its legislation and landmark cases in this field, as well as to develop long-term links between the Chinese and European judiciary.

EU-China workshop on trade secrets protection, Qingdao, 20-21 May 2010
IPR2 will co-operate with the State Administration for Industry and Commerce (SAIC) in implementing an expert workshop on the legal framework governing the protection of trade secrets. Chinese and European academics, officials and practitioners working the field of trade secrets protection will review and discuss questions raised by SAIC and provide suggestions for the amendment of the Chinese legal system.
