IPR2 undertook a number of activities in March 2010 – including three workshops, a training programme, an expert meeting, a study tour, mediation support and updating a publication – covering China’s design protection system, trademark classification practices, customs co-operation, management of IP in science and technology programmes, patent enforcement, IP protection at trade fairs, application of the Anti-Monopoly Law and Copyright Law; as well as finalising the work planning for the coming third year of implementation. NEW WORK PLAN - MORE ACTIVITIES, MORE RESULTS FOR EU-CHINA IPR CO-OPERATION
IPR2 3rd Annual Work Plan: IPR2’s Annual Work Plan for the third year of implementation has been endorsed by the EU Delegation and China’s Ministry of Commerce. This work plan provides the framework activities for April 2010 to March 2011 and follows close consultation and agreement with the numerous ministries and authorities responsible for IP protection and enforcement in China. More than 30 areas of activity have been identified for the coming year with exchanges between officials, experts, and industry, covering the revision of China’s IP laws, in particular the Civil Procedure Law, the Copyright Law and Trademark Law and protection of trade secrets; strengthening the administrative and enforcement capacity of local Chinese IP offices and enforcement assistance centres; practical enforcement of copyrights on-line, raising awareness of China and Europe’s IP systems and more.
   
       
 









UP & COMING STAKEHOLDER BRIEFING - Results and perspectives 2010: Third year of China's National IP Strategy, third year of IPR2 cooperation, Vienna, 22-23 April 2010

Intellectual property protection in China: In 2010 IPR2 enters its third year of implementation in China. At the same time, China is moving into a third year of its national IP strategy. Business stakeholders in Europe are invited to a briefing and networking session in Vienna which will highlight the results and priorities of this joint technical assistance project and update on IPR protection and enforcement in China.

Business perspective: Industry will have the opportunity to be updated on the implementation highlights of China’s National Intellectual Property strategy and hear the views of business on its implications for the current environment of protection and enforcement of IP rights.

Register now: Input from stakeholders in Europe is essential to the work of the IPR2 Project; this session will welcome contributions and feedback from the wider IP community. WORK PLANNING - IPR2 Project Steering Committee meeting 2010, 8 March 2010, Beijing
IPR2 held its third Project Steering Committee (PSC) meeting together with the Chinese IP-related authorities and agencies partnering with the Project to approve the new annual work plan for the third year of implementation, April 2010 - March 2011. The meeting was opened by Mr Zhang Kening, Commercial Counsellor from the Department of International Trade & Economic Affairs of the Ministry of Commerce (MOFCOM) - the implementing agency on the Chinese side - and Dr Michael Pulch from the EU Delegation to China.
   
     
WORKSHOP - EU-China workshop on China's design protection system, 26 March 2010, Paris
China’s State Intellectual Property Office (SIPO), in the framework of IPR2, together with France’s Institut National de la Propriété Industrielle (INPI) and the Office for Harmonisation of the Internal Market (OHIM), held a workshop on China’s system for design protection for European industry and IP professionals investing in design protection.
 

   
WORKSHOP - EU-China workshop on trademark classification practice, Beijing, 25-26 March 2010
In the framework of IPR2, the Office for Harmonisation in the Internal Market (OHIM) together with China’s Trademark Office under the State Administration for Industry and Commerce (SAIC) organised a workshop on trademark classification practices in Europe and China. The workshop helped to identify issues for further development of China’s trademark classification system.
 

   
TRAINING - EU-China training on patent enforcement - developments in Europe, 15-19 March 2010, Beijing and 22-23 March 2010, Shanghai
IPR2, in co-operation with the Institute for International Intellectual Property of Peking University and Tongji University hosted training for patent judges, officials from the State Intellectual Property Office (SIPO) and patent professionals on recent developments in the European and German patent systems.
 
       
 


STUDY TOUR - EU-China study tour on management of IP in Science and Technology programmes, 2-13 March 2010, Germany, Belgium and Sweden
IPR2 supported a study tour for 5 senior officials from the Ministry of Science and Technology (MOST) on the management of intellectual property in Science and Technology programmes. The Department of Laws and Regulation of the Ministry of Science and Technology of the P. R. China (MOST), headed by Ms Lin Xin, Division Director General in the Department of Laws and Regulations visited EU and Member State ministries, technology transfer agencies, public and private sector institutions and industry in Munich, Bonn, Brussels and Stockholm. The study tour aimed to inform MOST on the function and use of IPRs, in order to build its IP management capabilities towards developing a more transparent, predictable IP environment and intensified legal use of IP.
   
       
 


EXPERT MEETING - EU-China Customs Action Plan: 2nd Expert Group meeting, 17-18 March 2010, Beijing
The second meeting between EU and China IPR customs experts was held with the General Administration of Customs of China (GACC) with the support of IPR2, as part of implementing the EU-China Customs Action Plan launched in January 2009. The two-day meeting focused on developing a systematic exchange of statistical information and building a network of seaport and airport customs authorities. It was held attended by local customs officials from Shanghai, Ningbo, Shenzhen, Beijing, Guangzhou, Xiamen and Huangpu Customs, GACC, the European Commission's DG TAXUD and customs officials from France, Germany, Hungary, Italy, Luxembourg, the Netherlands, Spain and the UK.
   
       
 
WORKSHOP - EU-China workshop on application of Anti-Monopoly Law in IP, Changsha, Hunan Province, 11-12 March 2010
IPR2 organised a two-day workshop with the State Administration for Industry and Commerce (SAIC) for enforcement officials from provincial/municipal AIC offices on the implementation of the Anti-Monopoly Law in the IP area with a particular focus on questions related to the abuse of IPR. More than 80 officials participated in in-depth discussions led by European and Chinese experts on the link between Competition Law and IP protection and interrelated topics on the Chinese and European legal systems as well as respective remedy framework.
   
       
 
MEDIATION - Return to CeBIT: IP protection at trade fairs, Hanover, Germany, 2-6 March 2010
IPR2 is continuing its close co-operation with the Ministry of Commerce (MOFCOM) in providing information and mediation services at trade fairs in Europe. Building on the successful experience at CeBIT 2009 and other European trade fairs, the mediation service returned to CeBIT 2010 to help address and resolve IP disputes for Chinese and European exhibitors.
   
       
 
New EPO President elected, 1 March 2010
The European Patent Office (EPO) has announced the election of Mr Benoît Battistelli from France, to succeed Alison Brimelow (UK) as President of the European Patent Office (EPO). Currently Mr Battistelli is Director General of the French National Institute of Industrial Property. His five-year term as President of the EPO will begin on 1 July 2010.
   
   
         
PUBLICATION – Updated IP Protection Roadmap: Second amendment of China’s Copyright Law, April 2010.
The second amendment of China’s Copyright Law came into force on 1 April 2010. Most notably, this included a revision of Article 4 which provides that copyright owners who exercise their copyright shall not violate the Constitution, laws or prejudice the public interest and the State shall perform supervision over publication or distribution of works as prescribed by law; and Article 26 which cites a new provision whereby using copyright as pledged property, the pledger and pledgee should register the pledge with the Copyright Administration of the State Council. The IPR2 Roadmap for Copyright Protection in China has been updated to include a reference to the new amendment. Read more>>
   
         





PUBLICATION - IPR2 Roadmap for IP Protection series on CD
The IPR2 Roadmaps provide information on the IP systems in China and Europe and to give guidance to both European and Chinese companies in protecting their IP. All issues are available to download free-of-charge from www.ipr2.org/roadmap and are also provided on a compilation CD.

Current titles in the series include Customs Enforcement in China; Trademark Protection in China; Patent Protection in China; Copyright Protection in China; IP Protection at Trade Fairs in Europe; Hoe to Apply for a European Patent; How to Register and Protect a Community Trademark; How to Register and Protect a Community Design.

Support to 6th EU-China IP Dialogue 2010, Beijing, 8-9 April 2010
IPR2 will support the 6th EU-China IP Dialogue, co-chaired the European Commission’s Directorate-General for Trade and the Department of Treaty and Law of the Ministry of Commerce of P.R. China. The Dialogue is an opportunity for both sides to exchange their views on developments with Europe and China’s respective IPR policy, update on progress made and consider the way forward on key action areas.

EU-China training on criminal IPR enforcement, Dongguan, 7-9 April and Wuhan 13-15 April 2010
IPR2 is organising training with the Supreme People’s Procuratorate (SPP) on criminal enforcement of IP rights for local procuratorates and prosecutors. The training with bring Chinese and European experts together to share best practice on handling criminal IP cases, as well as the supervision of transfer of cases from administrative enforcement authorities to the police and the introduction of on-line communication and information sharing platforms.

EU-China training on latest developments on IPR, Guangzhou, 6-7 April 2010
IPR2 is organising training with the College of Intellectual Property of Jinan University on the latest developments of IPR in the context of globalisation. The training will address IP professionals in Guangdong province, including judges, lawyers, academia, government officials, and graduate students from the IP College and the College of Economics at Jinan University; and aims to enhance local awareness of IPR protection and to promote IPR protection work among companies in the Pearl River Delta.

EU-China support to IP protection at trade fairs in Europe - Frankfurt Messe, Germany, 11-16 April 2010
IPR2 is continuing its co-operation with the Ministry of Commerce (MOFCOM) in 2010 to support the protection of intellectual property at trade fairs, with information and mediation support at the international Frankfurt Messe 2010, the world’s leading trade fair for architecture and technology.

EU-China support to IP protection at trade fairs in Europe - Hanover Messe, Germany, 19-24 April 2010
IPR2 is continuing its co-operation with the Ministry of Commerce (MOFCOM) in 2010 to support the protection of intellectual property at trade fairs, with information and mediation support at the international Hanover Messe 2010.

EU-China study tour on Trademark Law and IPR related issues on Civil Procedure Law, the Netherlands, France, Switzerland, 18-29 April 2010
IPR2 is supporting a study tour of officials from the Legislative Affairs Commission (LAC) responsible for drafting the up and coming revision of the Trademark Law. The delegates, from the economic and civil law offices of LAC, will meet with European justice and economic ministries, trademark offices, research and IP institutes, courts, industry associations and law firms as part of gathering and exchanging information relevant to their drafting work.

IPR2 Stakeholder Briefing & East Meets West forum, Vienna, 22-23 April 2010
Results and perspectives 2010: Third year of China's National IP Strategy, third year of IPR2 cooperation: In 2010 IPR2 enters its third year of implementation in China. This briefing will update stakeholders in Europe on IPR protection and enforcement in China in various areas (patents, copyright, trademark, etc) and on the results and planning for IPR2. EU-China study tour on on-line copyright protection, France, Belgium, Germany, 10-19 May 2010
IPR2 is supporting a study tour for a delegation of the Chinese Judiciary (Supreme People’s Court or SPC as well as Chinese High Courts and Intermediary Courts) on the protection of copyrights on the internet. The study tour aims to share experience on Europe’s latest developments of its legislation and landmark cases in this field, as well as to develop long-term links between the Chinese and European judiciary.
